Calculating Child Support in Atlanta

Every state has a specific formula which is used to calculate how much child support should be paid and by which parent. In most cases, the non-custodial parent (the parent with whom the child does not live) is responsible for most or all of the child support.

However, it is important that you have a strong case going into family court in order to have the best chance of a positive outcome. The judge can only use the information given to them to make a decision, in addition to the child support formula. If you and your spouse or the other parent of your child are able to come to a decision on your own, this plan can be proposed to the judge.

A few of the factors which may be considered by a judge include:

  • The needs of the child
  • Any economic challenges
  • The earning capacity of each parent
  • The job and income of each parent

Modifying & Enforcing Child Support

Depending on the circumstances, the payments may be enforced if one parent refuses to pay. The penalties for failing to pay child support can vary, but may include wage garnishment, fines, and other more serious consequences such as jail time. Our Atlanta child support lawyer may be able to help you seek enforcement for non-payment. We can also help you request a modification, should your circumstances change.
